Criminal Breach of Trust occurs when anyone in the position of a “trustee” of anything for a beneficial use, on behalf of another person, or public or charitable organization, acts to or has intent to defraud, or use anything in trust that has not been authorized by the trust. In short, it is the abuse of trust (normally) in a public office. This can be an act or omission committed by the trustee which is in-congruent with the terms or laws set out in the trust agreement.

Penalties for Breach of Trust in Toronto
Anyone found guilty of Breach of Trust may be required to pay back or return what was taken, face other fines, and/or may face up to 14 years in prison. Forgery & theft can result in up to 10 years in prison.
